Generous school superintendent gives more

FRESNO, Calif.?? The school superintendent in California who is forgoing hundreds of thousands of dollars in pay and benefits to help offset budget cuts to his school district has decided to give away even more.

Fresno County Superintendent Larry Powell recently volunteered to return more than $288,000 in annual salary and benefits for the next three-and-a-half years of his term. He technically is retiring, allowing him to collect a six-figure annual pension, then will be rehired with a $31,000 salary.

On Monday, Powell told The Associated Press that he's also planning to donate that $31,000 salary to charity.

In an arrangement worked out with the district, Powell will retire on Thursday and then be hired back to fill the remainder of his four-year term. Powell will collect his retirement of roughly $200,000 a year while working fulltime for the district. But the salary he would be earning as superintendent stays in the general fund budget and is now going toward at-risk educational programs.

By staying on the job, the 63-year-old Powell saves the district from having to pay another superintendent's salary. He had to give up his $250,000 life insurance policy and will go on his wife's health care plan.

Because he retired early, Powell said he'll receive $28,000 a year less in pension payments for the rest of his life than he would have earned had he stayed on the district's payroll until the end of his term.

Powell said that if he lives to be 87, the current age of his parents, the early retirement will cost him $900,000 in reduced pension benefits, including $200,000 less in earnings for the remainder of his term.

Until his term expires in 2015, Powell will run 325 schools and 35 school districts with 195,000 students, all for less than a starting California teacher earns.

"How much do we need to keep accumulating?" Powell said last week . "There's no reason for me to keep stockpiling money."

After an AP story ran about his initial pay sacrifice, U.S. Secretary of Education Arne Duncan phoned Powell Monday to thank him for his generosity.

"Larry Powell's leadership is an absolute inspiration," Duncan said in a statement. "Through a lifetime of dedicated service in education and his generosity, he has made it clear that he is personally and professionally invested in the students, parents, teachers and principals in Fresno. They are very lucky to have him."

Powell's exploits also drew praise in an editorial Monday in the Contra Costa Times, which began: "Every once in a while a news story comes along that restores our faith in the basic goodness of humanity. The story of Fresno County School Superintendent Larry Powell is just such a case."

Sino-Forest's Chan resigns as chairman and CEO (Reuters)

TORONTO/NEW YORK (Reuters) ? Sino-Forest, a Chinese forestry company accused of fraud, said on Sunday Allen Chan had resigned as chairman and CEO and that it placed three senior employees on administrative leave, due to information uncovered in an ongoing internal review.

Toronto-listed Sino-Forest has seen its stock price plummet since June, when short-seller Carson Block accused the company of fraudulently exaggerating the size of its forestry assets. Sino-Forest had denied any wrongdoing and appointed a committee of its independent directors to investigate the matter.

However, on Friday, the Ontario Securities Commission (OSC) ordered a 15-day halt in trading of Sino-Forest shares and said it appeared that Chan and other executives had misrepresented revenues and kept bogus accounts.

The Sino-Forest saga is the most prominent among a series of accounting scandals in recent months to have tainted the image of Chinese companies listed in North America. The scandals have prompted trading halts, de-listings, lawsuits and regulatory probes both in Canada and the United States.

Shares of Chinese clothing and footwear company Zungui Haixi, just a week ago, fell more than 75 percent after the company said auditor Ernst & Young suspended its audit pending an investigation into certain issues it identified.

Sino-Forest's own market capitalization has fallen by roughly C$4 billion since Block and his firm, Muddy Waters, accused the company of fraud on June 2.

Sino-Forest said Chan voluntarily resigned as chairman, CEO and director pending completion of the internal review. Judson Martin, the vice chairman, becomes CEO and Lead Director William Ardell, who heads the internal probe, is now chairman.

The company did not provide details on what prompted these actions, but indicated that Chan agreed to step aside prior to the issuance of the OSC's cease-trade order.

"The three overriding priorities of the company are to complete the work of the independent committee, to cooperate with the OSC and to preserve shareholder value," it said.

Chan will become founding chairman emeritus and will assist with operational matters and the internal review, as requested, the company said in a brief statement. It did not identify the three employees placed on administrative leave, but said they would remain available to assist the company, if required.

A fourth senior employee has been asked to act solely on the new CEO's instructions and help with matters relating to the review and the company's operations, Sino-Forest said.

David Horsley will continue as chief financial officer, while Tom Maradin will remain vice president of corporate finance, the company said.

OSC INVESTIGATION

The OSC, Canada's main securities regulator, is continuing its Sino-Forest investigation and on Friday demanded that Chan and four other officers resign. But in a surprising about-face, it rescinded that order, saying it lacked the power to force them out until after a hearing, expected within 15 days.

The company said it has been cooperating with the OSC throughout, by responding to numerous and extensive information requests and providing regular periodic briefings. It noted that the allegations made by the regulator are still unproven.

The company said its own review would likely take another four months to complete.

Sino-Forest also said the OSC's stock trading halt will not trigger any defaults on outstanding debt. The company "does not believe any default under its guaranteed senior notes or its convertible senior notes has been triggered by these events."

Sino-Forest would continue to review the terms of all of its debt and other contractual arrangements, it added.

According to its annual information form for the year to December 31, 2010, Sino-Forest had outstanding short- and long-term debt of $2.07 billion. Beyond $87.7 million being repaid this month, Sino-Forest has no other long-term debt due this year.

It does have roughly $345 million in long-term debt due in 2013, along with $424.5 million that matures over 2014 and 2015, according to the 2010 annual report. As of June 30, the company held cash and cash equivalents of about $900 million.

A special lead

A referred lead is different than a lead that found you online and moved through your education system. Some folks make the mistake of lumping referrals in with every other lead in the sales funnel. I believe that you owe it to your referral source to make big deal about the fact that this lead was referred. Go out of your way to let them know they are special. Acknowledge the fact that you are going to honor the referral by giving them access to something special, invite them to a unique event or assign them to your referral specialist.

Lady Gaga might not have been at the Video Music Awards on Sunday night, but her stand-in, male alter ego Jo Calderone, promised MTV News that Gaga couldn't have been more excited about nabbing two more Moonmen.

"You know, I think that this award means more to her than anything she's ever received," he told us backstage. "She was texting me after the award, after I picked it up for her, and she just said, 'You know, more than anything I've ever gotten before, this means more to me, because "Born This Way" is about the fans and the fans are more important to me than anything I do; more important than f---ing breathing, you know?' "

And Calderone wasn't lying: Gaga later took to Twitter to thank her dedicated fans for their votes. "I couldn't be more overwhelmed+grateful as I am tonight. Little Monsters inspire me. Never give up on your vision, you were born this way," she wrote. "To win 2VMAs, Best Video with a Message + Best Female Video for 'Born This Way' means the world. I have never believed in a work so much."

Bright, sparkly lights designed in an arc pierced the stage and shone down on R&B singer Chris Brown as he hit the stage at Sunday's Video Music Awards.

Dressed in a white formal suit, the performer slow-shuffled down to the dance stage, and once he landed in the middle of the dance floor, he was flanked by full-skirted dancers. He gyrated and danced and sang his hit "Yeah 3X," while Kanye West jumped to his feet and clapped his approval.

On the psychedelic set, Brown high-stepped his way through the track, and eventually was joined onstage by tuxedo-clad dancers. He then moved into the 1993 Wu-Tang Clan classic "Protect Ya Neck," moving to the '90s backbeats in traditional hip-hop dance breaks.

His routine then moved to 1991, making the unexpected to choice to dance to Nirvana's "Teen Spirit," and one of Brown's dancers jumped on a trampoline to the rock classic.

Brown then came back to the future when he began singing his latest hit, "Beautiful People." Things really reached new heights as Brown was elevated high above the crowd, connected to invisible wires, as the crowd cheered as he landed on another stage.

Once he landed, he did a running-man routine, with him and his dancers moving in place and high-stepping their way through the hit. Later, other dancers were elevated and positioned behind him to join in on the routine.

Brown then went back in the air, back-flipped and yoga-posed midair in a "Matrix"-like performance. Every time he went up in the air, he did splits and back-flips.

While his "Look at Me Now" video was nominated, he hit the stage without collaborators Lil Wayne and Busta Rhymes.

Detainees disappear into black hole of Saudi jails

JEDDAH, Saudi Arabia?? Outside a villa surrounded by palm trees on the outskirts of Saudi Arabia's second largest city Jeddah, police cars guard an exceptional criminal court where 16 men were put on trial this year after more than four years detention.

The men face charges of "funding terrorism" and coordinating with al-Qaida to take power along with a host of other charges finally pressed last year.

Rights activists say the prisoners -- from well-known Saudi families, including professors and a former judge -- were really seized for refusing to heed Interior Ministry warnings to give up political activism and were planning to set up a political party.

"My father is a person who cannot be silent about what is wrong, whether it is in the street, in our house or in society," Eman al-Shemairi, the daughter of one of the men, said in a video put up on YouTube in March.

But the Jeddah detainees are more fortunate than many.

Islamic state ruling
Thousands of people have disappeared into the black hole of Saudi prisons without charge or any indication of when they could be released, Saudi and international rights groups say.

The government says it is an Islamic state ruling via Islamic Sharia law, according religious scholars wide powers in society and an advisory role to the Saudi royal family, which accords itself a benevolent paternal role.

Activists say the result is that security forces can act with impunity, and defendants are subject to an individual judge's interpretation of Sharia law and in many cases are not allowed access to their lawyers.

Without a penal code, there is even confusion over definitions, including what "detentions" and "political prisoners" are.

Saudis can find themselves in a revolving door of detention, release and detention, making it hard to clearly call someone a detainee or to track numbers.

And in a system where there is no room for political parties or democratic political processes, there is no concept of a political crime, and therefore no political prisoners.

The long reach of security forces, with a free hand to detain at will, was a major complaint of protesters who took to the streets in Tunisia and Egypt earlier this year, toppling veteran rulers and sending shockwaves throughout the region.

The government says that would not happen in Saudi Arabia because of its Islamic system and the popularity of King Abdullah, in his mid-80s, though it is unclear how much of that popularity has filtered down to the rest of his family.

'No political prisoners'
"We reiterate that there are no political prisoners in the kingdom," Interior Ministry spokesman Mansour al-Turki said.

The ministry said 5,696 people had been detained by the authorities in "militant" cases, adding that 5,080 of them had now appeared before courts as the authorities try to get through a backlog of people detained since at least 2003.

Saudi Arabia began battling al-Qaida militancy in 2003, detaining thousands on suspicion of links to militant groups, but dozens were also detained earlier this year following small pro-democracy protests and gatherings in the Eastern Province.

Protesters gathered outside the Interior Ministry in Riyadh to demand the release of relatives in March.

Saudi Arabia also has a "morality police" apparatus run by the powerful clerical establishment in coordination with the Interior Ministry, meaning it is possible that some state security detainees are being held for suspected crimes against Islam such as insulting the Prophet Mohammad, denigrating the Quran or "sorcery".

The independent rights groups say there could be anything from 12,000 to 30,000 people in those Saudi prisons which are used specifically for cases involving national security issues.

The independent Saudi rights body Human Rights First puts the number of security apparatus detentions at between 12,000 and 15,000, its head Ibrahim al-Mugaiteeb said.

"We monitor statements from the Ministry of Interior ... but for thousands of the people arrested we find out about them from their families," Mugaiteeb said.

The Saudi Civil and Political Rights Association (ACPRA) says it believes that all prisons connected to the Directorate of General Investigations (DGI), the state security apparatus, are full, which would put the total held at around 30,000.

Last week it sent a public letter to the Interior Minister Prince Nayef detailing cases where it said security offences had been fabricated to justify arrests of political activists but many had simply fallen foul to the whims of security officers.

'Terror law' in the works
UK-based Amnesty International says it estimates the number of people who have been detained in the thousands, some for criticizing government bodies and others for security reasons.

"There is a high level of secrecy maintained by the security in Saudi Arabia which makes it difficult for human rights organizations to have a precise number and details of people detained," said Dina El-Mamoud, an Amnesty researcher.

"We know that thousands have been arbitrarily detained in Saudi Arabia since 2001," she added.

Saudi Arabia is in the process of studying new terror legislation that was criticized by Amnesty in July after it obtained a copy of the draft Penal Law for Terrorism Crimes and Financing Terrorism and published it on its website.

If passed, the new law would allow suspects accused of "endangering ... national unity" and "harming the reputation of the state" to be held incommunicado indefinitely as terrorism suspects, if approved by a special court, the draft said.

The law would also stipulate a minimum 10-year jail sentence for questioning the integrity of the king or crown prince.

The ACPRA says the special courts are an infringement of rights in themselves.

"These courts violate the rights of defenders and prisoners, document forced confessions extracted under torture and coercion," it said this month.

Libyan rebels to seek U.N. seat next month (Reuters)

ISTANBUL (Reuters) ? The Libyan rebel political leader said on Friday the transitional government-in-waiting will seek a seat at the United Nations next month following the apparent overthrow of Muammar Gaddafi this week.

"We hope that next month Libya will be occupying the seat it holds at the United Nations," Mahmoud Jibril told a news conference in Istanbul.

Libyan rebels, still battling pockets of loyalists in their hunt for fugitive strongman Gaddafi, have announced a move to govern the country from the capital, Tripoli.

Jibril, who met with Turkish Foreign Minister Ahmet Davutoglu after Turkey hosted the Libya Contact Group of international powers on Thursday, said it was vital the National Transitional Council received financial aid to provide services.

"When the regime collapses all eyes will turn to the NTC to provide the Libyan people with services they have been deprived of for the last six months, including power and salaries," he said.

"In order to meet the expectations we need the finances. It is very important that the Libyan people don't feel deprived of resources."

Jibril also said the North African Arab country needed to rebuild its police and armed forces to re-establish security.

"We have to establish an army, a strong police force to be able to meet the needs of the people and we need capital and we need assets. All our friends in the international community speak of stability and security. We need that too."

Libya rebels: we face crisis if assets not freed (AP)

ISTANBUL ? The head of the Libyan rebel government has again called for the urgent release of frozen Libyan assets saying it could face a "legitimacy crisis" if the people's needs are not met.

Mahmoud Jibril, head of the National Transitional Council, on Friday also urged the African Union to recognize the rebel government, a move that would ease the freeing up of Libya's frozen assets.

Jibril said the opposition needed the money to pay state salaries and maintain services in Libya, including in areas still under Moammer Gadhafi's control. He spoke Friday in Turkey, where he attended a "Contact Group" meeting the previous day.

The U.S. and South Africa reached a deal Thursday that will release $1.5 billion in frozen Libyan assets in American banks.

European stocks up on Fed hopes but Asia slides (AP)

BRUSSELS ? European stocks held on to small gains Wednesday, shrugging off a credit downgrade of Japan that weighed on Asian markets, as investors hoped that the Federal Reserve will this week announce more stimulus for the U.S. economy.

Markets are expected to fluctuate ahead of Friday's speech by Fed Chairman Ben Bernanke at an economics conference in Jackson Hole, Wyo.

Hopes that Bernanke will signal new action to kick start the struggling U.S. economy helped lift most major markets Monday and Tuesday, in spite of disappointing indicators on both sides of the Atlantic, and appeared to persevere in morning trading in Europe.

Britain's FTSE 100 rose 0.4 percent to 5,148. Germany's DAX was 1.1 percent higher at 5,590 and France's CAC-40 rose 1 percent to 3,114.

Wall Street, however, appeared to be headed lower, after recording big gains Tuesday. Dow Jones industrial futures and S&P 500 futures were down 0.8 percent at 11,075 and 1,152 respectively.

That followed losses on most major Asian markets, as well as declining oil prices, underlining investors' reluctance to commit to assets that could quickly lose value if the global economy heads for another downturn.

"If Bernanke does not pull a rabbit out of the hat at Jackson Hole on Friday risk trades could look vulnerable once again," warned analysts at Credit Agricole.

Fresh data out of the eurozone indicated that businesses are already preparing for potential troubles.

Germany's closely watched Ifo index of business optimism for fell more than expected in another negative signal about Europe's largest economy. The index fell to 108.7 for August from 112.9 in July. Market analysts had expected a smaller drop to 111.0.

"August's drop in Ifo business confidence adds to the growing evidence that the German economic recovery has faltered," analysts at Capital Economics wrote in a note, adding that a slowdown for the eurozone's growth engine is set to hurt other members of the currency union that are still fighting to pull themselves out of crisis.

In Asia, Japan's Nikkei 225 index fell 1.1 percent to close at 8,639.61 after opening higher early Wednesday.

Sentiment was dented after Moody's Investors Service downgraded Japan's credit rating to Aa3 from Aa2, citing weak growth prospects for the world's No. 3 economy, massive government debt and constant political uncertainty. The new rating is three notches below Moody's top Aaa rating.

The downgrade, which puts Moody's rating in line with other major credit rating agencies, is the latest blow for Japan after its economy remained mired in recession in the second quarter due to tumbling factory production and exports following the March 11 earthquake and tsunami.

South Korea's Kospi dropped 1.2 percent to 1,754.78. Hong Kong's Hang Seng tumbled 2.1 percent to 19,466.79.

Australia's S&P/ASX 200 fell 0.1 percent to 4,167.60 after spending much of the session in positive territory. Markets in Singapore, Taiwan and Indonesia also fell.

Mainland Chinese shares were mixed with the benchmark Shanghai Composite Index falling 0.5 percent to 2,541.09 while the Shenzhen Composite Index edged 0.1 percent higher to 1,144.74.

In commodities markets, benchmark oil for October delivery was down 16 cents to $85.28 a barrel in electronic trading on the New York Mercantile Exchange. In London, Brent crude for October delivery fell 27 cents to $109.04 on the ICE Futures exchange.

The euro rose, meanwhile, to $1.444 from $1.442 in late trading Tuesday in New York. The dollar fell to 76.54 yen from 76.66 yen.
