Samsung has, to some surprise, won a patent battle against Apple that could see the iPhone 4 and 3G iPad 2 banned from sale in the US.
The legal fight was centered on a patent relating to 3G standards, which Samsung has pledged to license freely, reports the Guardian. But according to the International Trade Commission, the patent?US patent 7,706,348?was infringed by the iPhone 4 and 3G iPad 2. You can read the order below.
While Apple claimed that Samsung failed to license the patent on "fair, reasonable and non-discriminatory" (FRAND) terms, the ITC was having none of it. Apple will now appeal the verdict?it's claiming that it will have "no impact" on sales?but in reality the iPhone 4 and 3G iPad 2 could be banned from sale in the US. The iPhone 5 and 4S are unaffected by the decision. [Guardian]
